Whether any changes were needed to update the existing guidance setting out the legal and policy background to the Council’s contribution requirements towards Primary Education, Auchterarder A9 Junction Improvements, Perth Transport Infrastructure, and the Council’s Affordable Housing requirement.

Comments received on the draft guidance were generally supportive, some sought clarification but none sought changes relating to its principles.

We did

A range of minor amendments were made to the Guidance before it was approved at the Council’s Strategic Policy and Resources Committee on 29 January 2020. The Developer Contributions and Affordable Housing Supplementary Guidance was submitted to Scottish Minsters for consideration and on 16 July the Guidance was adopted, incorporating a modification directed by Ministers.

We received 12no. responses to the consultation either supporting the guidance or seeking clarification on its key elements. No issues relating to the principles were raised. Some amendments were made to clarify the application of the guidance.

Overview

The Developer Contributions and Affordable Housing Supplementary Guidance sets out the detail of the Council's approach to securing developer contributions and affordable housing. This is required for new development across Perth & Kinross. The Guidance is aimed at developers and people working on preparing planning applications. We are updating our Supplementary Guidance to provide clarification and to improve consistency of application when assessing and determining planning applications. This consultation provides an opportunity to provide comments on the revised Guidance which will inform future modifications prior to adoption.

Why your views matter

The Developer Contributions and Affordable Housing Supplementary Guidance was adopted by Perth & Kinross Council in September 2016. This Guidance provides detail of the requirements of developer contributions in relation to Primary Education, Auchterarder A9 Junction Improvements and Transport Infrastructure as well as details of the Affordable Housing requirement from appropriate developments. Through the review of the Local Development Plan (LDP), all Supplementary Guidance is required to be reviewed and consulted upon prior to re-adoption along with the new LDP.

This process has allowed for a full review of the current Guidance to be carried out and modifications to clarify and improve the consistency of application of the Guidance have been made. The revised Guidance was considered by the Strategic Policy and Resources Committee on 12 June 2019 (Report No. 19/171) and approved for public consultation.

This consultation will provide an opportunity for all stakeholders to make comment on the proposed changes to the adopted Guidance. All responses to the consultation will be fully considered and will be used to inform any further modifications. The Guidance and all consultation responses received will be reported back to Committee. 

The consultation will take place online, but there is an opportunity to discuss specific elements of the Guidance with the Council’s Developer Negotiator during the period of consultation.

What happens next

The Council will consider the issues raised in the comments that were made during the consultation. We will prepare a report setting out the comments we received and an explanation of how these comments were taken into account when preparing and finalising the Supplementary Guidance. The finalised Supplementary Guidance will be issued and adopted, and it will then form part of the Development Plan and will be used when determining planning applications.
