River Tay Special Area of Conservation (SAC) Guidance

We asked
To support the Local Development Plan, we revised the guidance on the types developments that may impact the River Tay Special Area of Conservation and the types of information and safeguards to be provided in support of planning applications. We asked you to give us your views on the revised text and suggest improvements.

We received two comments on the draft, from SEPA and Naturescot (previously SNH), suggesting minor amendments to the wording of the guidance.
We did
All comments were considered and the suggested minor modifications were made to improve the wording of the guidance. The River Tay SAC Guidance was adopted by the Council in November 2020.

Overview
The River Tay Special Area of Conservation (SAC) Guidance relates to the protection of the River Tay Special Area of Conservation catchment. SACs are the highest wildlife designations and are part of the Natura 2000 network - a series of internationally important wildlife sites throughout the European Union. The guidance provides advice on the types developments that may impact the SAC and sets out the types of information and safeguards to be provided in support of planning applications. The document was prepared in consultation with Scottish Natural Heritage and Scottish Environment Protection Agency.
Why your views matter
The River Tay Special Area of Conservation Guidance was last updated by Perth & Kinross Council in November 2016. This consultation draft is a technical update of the existing 2016 guidance with a rationalised catchment boundary.
This consultation will provide an opportunity for all stakeholders to make comment on the proposed changes to the adopted Guidance. All responses to the consultation will be fully considered and will be used to inform any further modifications.
Strategic Environmental Assessment
Based on the criteria that are set out in the Environmental Assessment (Scotland) Act 2005, we concluded that the proposed changes to the guidance are likely to have no or minimal environmental effects. Our Pre-screening Notification sets this out in more detail.

What happens next
This consultation has now closed. Your comments are valuable because they will be used to shape the final version of the guidance.
The Council will consider the issues raised in the comments that were made during the consultation. We will prepare a report setting out the comments we received and an explanation of how these comments were taken into account when preparing and finalising the guidance. The finalised guidance will be issued and adopted and will be used when determining planning applications.
